Atlanta Family Attorney

Guiding Atlanta’s families through divorce, child custody and related matters

Everyone has a family – some family we choose and some family we are born into. The family we choose – like our friends and our spouses – means just as much to us as our blood relatives. We create families with our spouses and with our friends. Sometimes things do not work out the way we hoped or thought they would. We do not enter into a relationship thinking it will end – we enter into a relationship hopeful for the future. Inevitably, some of those relationships end. We understand that our clients may be the ones ending the relationship such that they are ready to move on, or they may be blindsided by it and may need emotional support as well as legal advice. We are prepared to give both. Our clients come to us for all types of family law cases on which we have substantial experience: divorce, child custody, grandparents’ rights, prenuptial and postnuptial agreements, legitimation, paternity, or domestic violence. Our lawyers have over 100 years of combined solution-focused advocacy experience.

We have represented people just like you – complex financial situations, business owners, CEOs, stay-at-home parents, parents of special needs children, high-conflict parents, decades-long marriages, short marriages, high-profile people, LGBTQ.. the list goes on – suffice it to say, we are here for you, and we are prepared for you and your case. At Kaye, Lembeck, Hitt & French Family Law, our Atlanta family attorneys ensure you understand the law that applies to your case. We take the time to understand your needs and craft solutions to reach your goals. Our lawyers are here for you, because if it matters to you, it matters to us.

Divorce

You did not get married thinking you would get divorced. Unfortunately, roughly half of all marriages end in divorce. Ironically, the divorce rate is even higher for people in their second or third marriage. You may feel alone, confused, angry, scared or sad. You may feel relieved, free, light and hopeful for the future. You may not feel anything because you are numb. Regardless of how you feel, our solution-oriented team is here to help you navigate from where you are now to the next phase of your life.

Learn more about Georgia divorce laws below, and contact Kaye, Lembeck, Hitt & French Family Law if you are considering divorce or if you have been served with divorce papers from your spouse.

Our solution-oriented attorneys possess a wide range of experience in Atlanta divorce cases, including amicable and uncontested divorces, high-conflict divorces, high-asset divorces, and same-sex marriage and divorce cases. Additionally, we are here for you after the divorce has been finalized if you need help with modification or enforcement of court orders.

Paternity and Legitimation

Sometimes a woman becomes pregnant, and she is not married to the person who impregnanted her. Being married and having a child together creates rights and responsibilities for both parents, while having a child when unmarried creates a void in those rights and responsibilities. So, now what? Sometimes no one wants to do anything about that, and that’s okay. Sometimes, either the mother or the father wants to establish the rights and responsibilities to the child and that where paternity and legitimation actions come into play.

The Atlanta family law solution-oriented attorneys at Kaye, Lembeck, Hitt & French Family Law can advise you on your rights and options as a mother or father. We can guide you through the processes of paternity and legitimation or advocate your interests in court for matters in dispute. Learn more about paternity and legitimation below, and call our offices to discuss your needs.

Grandparent Visitation

Parents are given some deference when it comes to decisions like whether to allow access to their children by the grandparents, but this deference may not be absolute. Grandparents have some rights as well, and, on occasion, the law allows them to intervene in a divorce or child custody dispute or file their own petition to enforce a legal right to visitation. If the court thinks visitation is in the children’s best interests, the judge may order it. Our solution-focused advocates have represented grandparents in pursuit of this time with their grandchildren as well as parents in their efforts to prevent grandparents from having this time.

Prenuptial and Postnuptial Agreements

Before going into marriage or at any time during the marriage, couples can create binding agreements regarding issues like property division or alimony in the event of a future divorce. Deciding these matters now in a practical and rational setting can save agony and expense down the road, as well as strengthen a relationship and increase the chances the agreement will never need to be implemented. Our Atlanta family law attorneys can advise you and represent you in negotiating, drafting or reviewing these agreements to ensure their validity, or advocating for or against their validity in court if necessary.

Domestic and Family Violence (restraining orders and protective orders)

Sometimes our clients find themselves in a violent situation. Georgia law defines domestic violence as an assault, battery, or any felony committed on a current or former spouse, parent, child, co-parent of common children, or member of the household. Our solution-focused team acts swiftly to help you get the safety of a temporary restraining order as well as a longer-lasting Family Violence Protection Order, if necessary. Other times, our clients find themselves being accused of abuse. If you are being accused of abuse, you’ll find our lawyers to be thorough and effective advocates for your rights.
