It Starts with the Georgia Child Support Guidelines

Georgia has a formula for determining child support called the Georgia Child Support Guidelines. The Child Support Guidelines combine the incomes of both parents, as well as child care costs and insurance costs to determine a presumptive amount of child support. That amount can be adjusted up or down through negotiation as well as deviation by the Court.

Georgia child support law lists a number of different reasons why a judge might order a child support payment that is different from the Guidelines amount. These factors include:

  • A parent’s ability to pay
  • High income (more than $30,000.00 combined monthly income)
  • Low income
  • Health insurance
  • Life insurance
  • Child tax credits
  • Transportation costs related to custody or visitation
  • Mortgage payments
  • Extraordinary health, education or other expenses for the child
  • The division of parenting time
  • Other nonspecific deviations in the best interest of the child

The Child Support Guidelines require the parents to disclose all income from any source and lists several sources specifically, including salaries, commissions, tips, self-employment income, bonuses, overtime, severance pay, pension or retirement payments, interest income, dividend income, trust income, annuity income, capital gains, disability benefits, workers’ compensation, unemployment benefits, judgments from personal injury or other civil actions, gifts, prizes, lottery winnings, alimony from a previous relationship, and more.

It is not easy to report all of your income completely and accurately, and it is more difficult to ensure the other party is doing the same. If either parent is self-employed, unemployed or arguably underemployed, or if income comes from unusual sources, disclosing income correctly can be complex.
